Florida cosmetology license or specialty registration, esthetician, and nail tech pre-licensure HIV/AIDS course requirements.

Meeting the HIV/AIDS Course Requirements for the Florida License Application Process:

What you need to know about HIV/AIDS training when applying to the Board of Cosmetology for a Florida license.

4-HOUR HIV/AIDS COURSE APPROVED TO MEET THE APPLICATION TRAINING REQUIREMENTS
Earning the correct HIV/AIDS course certificate needed to satisfy the conditions for licensure and the Florida license application process requires the successful completion of a board approved 4-hour HIV/AIDS salon training course that the board approved specifically for satisfying the application training requirements. If a certificate of course completion is submitted to the state as part of an application for a license or registration that doesn’t come from an HIV/AIDS course the board approved for the application process it will be rejected and credit for completing the (unapproved for licensing) course will be denied. Processing of the application will be halted until a certificate is received that was earned by completing a 4-hour HIV/AIDS salon training course approved by the board for the application process.

BOARD APPROVED HIV/AIDS COURSES REJECTED FOR THE PURPOSE OF THE LICENSE APPLICATION PROCESS
A common error is made when the certificate of course completon for a 16-hour continuing education program aproved by the board for purposes of license renewal is submitted with an appliction for a license or registraion. The error occurs by thinking the HIV/AIDS course contained in all 16-hour license renwal programs will meet the application requirement to complete an HIV/AIDS course and submit the certificate, because the state approved it and because it has an HIV/AIDS course contained within. This is incorrect thinking. This is not how it works and submitting a certificate for the completion of a program approved for license renewal does not meet license or registation application requirments. Consequently, in such an instance, processing of the applicatin is halted pending a certificate be submitted from a 4-hour HIV/AIDS course approved by the board specifically for satisfying license or registration application requirements for HIV/AIDS training. Because the board approves HIV/AIDS salon training for purposes other than the application process, applicants should be aware that because a course covers HIV/AIDS and because the board approved the course that any board approved HIV/AIDS course is acceptable when applying to get a license. If this sounds confusing it is because it can be, which is why an explanation is being given here.

The section below comes directly from the Florida Administrative Code rule 61G5-18.011, without modification. This portion of the law contains the rule making the completion of a board approved 4-hour HIV/AIDS training course a mandatory condition of the license application process, and outlines in detail all of the requirements expressly stated in the law with regards to initial licensure or registration requirement for Instructions on Human Immunodeficiency Virus and Acquired Immune Deficiency Syndrome; course content and course approval requirements.

61G5-18.011 Initial Licensure or Registration Requirement for Instruction on Human Immunodeficiency Virus and Acquired Immune Deficiency Syndrome; Course Content and Approval Requirements.

The applicant shall be required to submit proof of the completion of this course in the form of a certificate of completion from the provider of such course to the department within the 6 month period. A copy of the certificate will satisfy this requirement. Failure to submit such proof during the 6 month period shall cause any previously issued license or registration to become null and void without further action by the Board.

(3) All educational courses on HIV and AIDS which are taught to fulfill the requirements for initial licensure or registration under Chapter 477, F.S., shall be approved by the Board. To be considered for the Board's approval, courses on HIV and AIDS shall consist of 4 hours combined education of:

(6) Home study or video courses shall be approved by the Board, provided they meet the requirements set forth in subsection (3). Home study courses must require a 75% passing score on a post course test to be graded by the course provider.

(7) At any time, the Board shall deny or rescind its approval of a course offered for initial licensure if it finds that: such approval was the result of fraud; the course which is being provided fails to cover the information required by statute or subsection (3) or fails to meet other requirements specified in this rule; or the course significantly varies from the course proposal that was approved by the Board. Before rescinding approval of a course, the Board shall give the course provider notice and an opportunity to be heard. If the Board denies or rescinds its approval of a course because of the course provider's fraud in obtaining such approval, then the course provider shall thereafter be barred from presenting any other course to licensees for credit unless the course provider demonstrates to the Board that he or she has been sufficiently rehabilitated to be trusted to provide such courses to licensees in the future.
